1. Agreement
These Terms of Service form a binding agreement between you and Fino Labs ("Fino", "we"). By tapping "Create account", you confirm that you have read and accept these Terms and our Privacy Policy. If you are using Fino on behalf of someone else (for example a family member), you confirm that you have the authority to accept these Terms on their behalf.
2. The service
Fino reads the text on food packaging or restaurant menus and compares it to an allergy and intolerance profile you create. The result is presented as a helpful label-review aid, not as a definitive food safety determination.
Fino is not medical advice and not a medical device. It does not diagnose, treat, cure, or prevent any condition. Use of Fino does not establish a doctor–patient relationship.
3. Account responsibilities
- Provide accurate information when signing up
- Be at least 16 years old in the EEA/UK, or at least 13 elsewhere (or the local minimum, whichever is higher)
- One account per person — don't share login credentials
- Keep your password secure and notify us at [email protected] if you suspect unauthorised access
4. Acceptable use
You agree not to:
- Resell, sublicense, or rent the service
- Scrape, crawl, or use automated means to access the app or our APIs
- Reverse engineer or interfere with the security of the service
- Use the service to harass others, post unlawful content, or violate anyone's rights
- Submit content that you do not have the right to submit
"Unlimited" scans on Fino Pro are subject to a fair-use cap of 300 scans per month. Excess use may be rate-limited; persistent abuse may result in account suspension.
5. Subscriptions and billing
Fino offers a free tier (3 lifetime scans, one profile) and a paid tier (Fino Pro). Pro is offered at:
- $5.99/month — recurring monthly
- $39.99/year — recurring annually (best value)
Prices may differ in your local currency or App Store region. All Pro subscriptions are billed by Apple through your Apple ID. Apple's terms of sale apply to the payment itself.
Auto-renewal
Subscriptions auto-renew at the end of each period until cancelled. To cancel, open Settings → [your name] → Subscriptions → Fino Pro → Cancel Subscription on your Apple device, at least 24 hours before the renewal date.
Refunds
Refunds are handled by Apple according to their refund policy. Visit reportaproblem.apple.com to request a refund. Where local law (for example the EU consumer rights directive) entitles you to a withdrawal right, you may exercise it by contacting [email protected] within 14 days of purchase, before any non-trivial use of paid features.
Price changes
We may change subscription prices. Existing subscribers will be notified in-app at least 30 days before the new price takes effect, and may cancel before renewal.
6. Intellectual property
Fino, the Fino logo, the wordmark, and all original content, features, and functionality of the service are owned by Fino Labs and protected by international copyright, trademark, and other intellectual-property laws. You may not use the Fino brand without our prior written permission.
You retain all rights to the content you create (your allergen profile, saved items, scan history). By using the service you grant us a limited licence to process that content solely to deliver Fino to you.
7. Limitation of liability
To the maximum extent permitted by law, Fino is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Our aggregate liability to you for any claim arising out of or relating to the service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow exclusion of certain warranties or limitations of liability; in those jurisdictions, the above limits apply only to the maximum extent permitted by law and do not affect statutory consumer rights.
8. Disclaimers (please read)
Fino is informational only. The result of a scan is a best-effort interpretation of label text. It can be wrong because:
- OCR can misread small print, glare, curved or stylised labels
- Products change — manufacturers reformulate without warning
- Hidden ingredients exist in many products (carriers, processing aids)
- Cross-contamination occurs in shared production environments and is rarely reflected on the label
- Restaurant menus are often incomplete or out of date
You are solely responsible for what you eat. Always read the original package. For severe allergies, consult a medical professional and rely on direct verification with the manufacturer or restaurant.
9. Indemnification
You agree to defend, indemnify, and hold harmless Fino Labs and its employees, officers, directors, and affiliates from any claim, damage, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party right. This section does not apply where local law restricts indemnification by consumers.
10. Governing law
These Terms are governed by the laws of [Your jurisdiction — to be confirmed at incorporation], without regard to its conflict-of-laws rules. This choice of law does not deprive you of the mandatory protections of your country of residence.
11. Dispute resolution
Before filing a formal claim, please email [email protected] with the words "Notice of dispute" in the subject. We will try to resolve the dispute informally within 30 days. If we can't, disputes may be resolved through the courts of the governing jurisdiction in section 10, or, where applicable consumer law permits, in the courts of your country of residence.
12. Changes to these Terms
We may update these Terms from time to time. We post the new version here, update the "Last updated" date at the top, and — for material changes — show an in-app banner at least 30 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance.
